By clicking "I Agree" and completing your registration for the OMNI Log service (the "Platform"), or by accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
"User Content" includes all data, text, notes, dive log entries, session records (manual or uploaded from dive computers), photographs, videos, and comments that you create, post, or upload to the Platform.
You understand and agree that certain aspects of your User Content, including dive location, depth, time, and general session notes, may be shared with and viewable by other members of the OMNI Log community for the purpose of collaboration, verification, and community engagement. You are responsible for the content you choose to share.
In consideration for the use of the Platform, you hereby grant to the owners of OMNI Log (the "Platform Owners") a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Content (in whole or in part) and to incorporate such User Content into other works in any form, media, or technology now known or later developed.
This license explicitly grants the Platform Owners the right to repurpose your User Content for marketing, promotional, and commercial purposes, including, but not limited to, platform feature demonstrations, case studies, advertisements, or internal analysis and product improvement, without any further compensation or notification to you.
While certain data is shared within the community, personal identifying information (PII) such as email address and full name will be handled in accordance with our separate Privacy Policy. The data licensed in Section 4 and 5 will typically be used in an aggregated or anonymized format, though direct quotes or images may be used for marketing with attribution (e.g., "A diver from the community").
You acknowledge that freediving is an inherently dangerous activity that carries a high risk of serious injury or death. You agree that you will not freedive alone and will always follow safe diving practices with a qualified buddy.
OMNI Log is a logging and training companion. It is NOT a safety device, a dive computer, or a substitute for proper freediving training, certification, and sound personal judgment. Do not rely on the Platform for primary safety or navigation.
By using this Platform, you agree to assume all risks associated with your freediving activities. You hereby release and hold harmless OMNI Log, its owners, employees, and affiliates from any and all liability, claims, demands, or actions for any injury, death, or damages arising from or related to your use or misuse of the Platform.
